Hearing set for Monday on challenge to Gov. Tony Evers emergency order

A challenge of Gov. Tony Evers' emergency order requiring masks to be worn statewide will be heard by a St. Croix County Circuit Court Monday afternoon.

On Sept. 28,the Wisconsin Institute for Law and Liberty (WILL) filed an immediate injunction to block the order in Polk County Circuit Court. It was part of an amendment to a lawsuit they had filed there in August against Evers’ first mask mandate.

“This motion for an immediate injunction is a recognition that the executive branch in Wisconsin is, thus far, completely undeterred by the constraints of state law and must be reined in," said WILL President and General Counsel Rick Esenberg.

The motion will go before a St. Croix County judge after both Polk County judges recused themselves from handling the case.
