Shorewood police officer charged after man dies in custody

A Shorewood police officer is charged with a crime after a man in custody died on his watch, and the police chief said Sergeant Cody Smith lied about what happened.

Police say an officer found a 39-year-old man, who was being held for domestic violence, unresponsive in his cell in the middle of the night back in August.  He was brought in just two hours earlier.

Officers tried to save him, but the man later died at the hospital.  The medical examiner determined the man hanged himself. 

State law requires the Milwaukee County Investigate Team look into the incident and in the process they interviewed Smith.  He later admitted to "falsely documenting an additional visit that he says did not take place." 

We attempted to get Smith's side of the story, but no one answered the door to his home.

Smith was hired with Shorewood Police in February 2012.  He resigned from his position in August.  The former sergeant pleaded guilty to obstructing an officer.  He paid a $500 fine and spent a day in jail.
