WAUKESHA COUNTY- Sussex volunteer firefighter Thomas Gerstner who is accused of operating a fire truck while under the influence resigned on Friday.

Fire Chief Colin Curtis tells TODAY'S TMJ4 that Gerstner handed in his resignation Thursday night and Chief Curtis accepted it.

The resignation is effective immediately.

The 47-year-old was on duty and on his way to a Memorial Day service when troopers say he hit a parked car in a parking lot around noon.

Officials say his blood alcohol level was .08 and that this was his first offense.

During the investigation troopers determined the paid on call firefighter was also driving on a license that expired back in February.

In a statement Sussex Fire Chief Colin Curtis said, "Gerstner has been a dedicated 19 year member of the department" and that the department does "not tolerate inappropriate behavior by any member."

Gerstner will make his initial court appearance on June 29 on the OWI charge.
