The driver who hit and killed a suspected thief with her car last Friday was charged with homicide by intoxicated use of a vehicle Monday.

According to court documents, Samantha Walker, 26, of Milwaukee was officially charged after she told officers at the time of the incident that she hit Reynaldo Wilson, who died on the scene, while she was driving west on Wisconsin Avenue. Walker said she had tried to stop but was going too fast.

When officers searched Walker’s car, they found a half-empty bottle of tequila, and later determined she had a blood alcohol level of 0.135. Walker admitted to police she had been drinking and smoking marijuana that night with a friend.

Police also estimate Walker was driving 81 mph at the time of the crash in an area with a 30 mph speed limit.

Wilson was captured on a security stealing plastic bins from a nearby Walgreens, before he went out into the street.

Walker was also charged with homicide by intoxicated use of a vehicle with a prohibited alcohol concentration and knowingly operating a vehicle while suspended- cause death. Combined, the charges hold a maximum sentence of more than 50 years in prison.
