The family of Dontre Hamilton will be able to proceed with their civil suit against the city of Milwaukee.
A federal judge ruled Wednesday that there is evidence that Officer Christopher Manney performed an “unreasonable search” on Hamilton in Red Arrow Park.
The Fire and Police Commission had already ruled that pat-down was unreasonable.
Hamilton was shot and killed in the park nearly three years ago. The family filed afederal lawsuit last April.
